This Refund and Cancellation Policy (“Policy”) sets out the terms and conditions governing cancellations, refunds, and related matters in respect of courses, programs, mentorships, and other services offered by Bimal Institute for Market Research Private Limited, a company incorporated under the provisions of the Companies Act, 2013 (“Company” / “Institute” / “we” / “our” / “us”) through its website https://www.bimalinstitute.com/ and other platforms (collectively, the “Platform”). This Policy applies to all Users who purchase, enroll in, or otherwise avail any Service offered by the Institute.
By purchasing or enrolling in any Service, the User agrees to be bound by the terms of this Policy. This Policy shall be read in conjunction with the Institute’s Terms of Service. The Institute reserves the right to modify this Policy at any time, with such changes becoming effective upon publication on the Platform.
This Policy applies to all Users who purchase, enroll in, or otherwise avail any courses, programs, mentorships, or related services (“Services”) offered by the Institute through the Platform, whether through online or offline modes.
This Policy governs all requests for cancellation, refund, or any related claims arising out of or in connection with the purchase or use of the Services. This Policy shall apply uniformly to all Services unless expressly stated otherwise for a specific course, program, or offering. This Policy does not apply to services, products, or transactions offered by third parties, even if accessed through or in connection with the Platform. The Institute shall not be responsible for any refund or cancellation obligations of such third parties.
All purchases, enrollments, and payments made in respect of any Services offered by the Institute are final, non-cancellable, and non-refundable, except as expressly provided under this Policy. Upon successful enrollment in any Service, the User shall not be entitled to cancel such enrollment or claim any refund, whether or not the Service has been accessed, commenced, or utilised. Without prejudice to the generality of the above, no refund or cancellation shall be permitted on grounds including, but not limited to:
(a) change of mind, personal circumstances, or preference;
(b) dissatisfaction with the content, structure, delivery, or methodology of the Service;
(c) failure or inability to attend sessions, participate in programs, or utilise the Service;
(d) delay, non-performance, or lack of participation attributable to the User; or
(e) any subjective expectations not being met.
The User acknowledges that the Services involve access to digital content, training material, and intellectual property, which may be made available immediately or within a short duration of enrollment, and accordingly agrees that strict no-refund and no-cancellation terms are reasonable and necessary.
Notwithstanding anything contained in this Policy, the Institute may, at its sole and absolute discretion, consider requests for refund only in exceptional and limited circumstances, including:
(a) Duplicate Payment: where a User has made multiple payments for the same Service due to an error;
(b) Failed Transaction with No Enrollment: where an amount has been debited but the User has not been successfully enrolled in the Service;
(c) Technical Failure in Service Delivery: where a demonstrable and material technical issue attributable to the Platform results in complete non-provision of the Service;
(d) Service Not Commenced by Institute: where the Institute cancels or fails to commence a course, program, or session for reasons solely attributable to the Institute;
(e) Incorrect Transaction Amount: where the User has been charged an amount materially different from the price displayed at the time of purchase due to a technical or system error; and
(f) Unauthorised Transaction (Subject to Verification): where a User demonstrates, to the satisfaction of the Institute, that a payment was made without authorisation, subject to appropriate verification and supporting documentation.
Any request under this Clause must be submitted within seven (7) days from the date of the transaction and must be supported by appropriate documentary evidence, failing which the request shall not be considered. The Institute reserves the right to verify the authenticity of such requests and may require additional information or documentation before processing any claim.
For the avoidance of doubt, no refund shall be granted in cases where the User has accessed, consumed, or participated in any part of the Service, except where the circumstances fall strictly within the exceptions set out above. Any decision taken by the Institute under this Clause shall be final, binding, and not subject to further review or dispute.
In the event a refund request is approved by the Institute under Clause 3, such refund shall be processed in accordance with the following terms:
(a) the refund shall be processed within a reasonable period, as determined by the Institute, and in any event within such timelines as may be prescribed under applicable law;
(b) the refund shall ordinarily be credited through the original mode of payment used for the transaction, unless otherwise determined by the Institute;
(c) the Institute reserves the right to deduct applicable administrative charges, processing fees, payment gateway charges, taxes, or any other costs incurred in connection with the transaction;
(d) the Institute shall not be responsible for any delay in credit of the refund amount attributable to banks, payment gateways, or other third-party service providers; and
(e) no interest or compensation shall be payable on any refund amount under any circumstances.
The Institute reserves the right, at its sole discretion, to deny any refund request and/or take appropriate action, including suspension, restriction, or termination of access to the Platform or Services, in the event of any actual or suspected fraud, abuse, or misuse of the Services or this Policy. Without prejudice to the generality of the foregoing, the following actions shall be deemed to constitute fraud, abuse, or misuse:
(a) accessing, viewing, downloading, or otherwise consuming any portion of the Service, whether in whole or in part, and thereafter seeking a refund;
(b) initiating refund requests after substantial or partial utilisation of the Service;
(c) making multiple, repetitive, or unreasonable refund requests in respect of the same or different Services;
(d) providing false, inaccurate, misleading, or incomplete information or documentation in connection with any refund or cancellation request;
(e) engaging in any conduct intended to circumvent, manipulate, or exploit the terms of this Policy or the Platform, including through use of multiple accounts or payment methods;
(f) unauthorised sharing, distribution, or misuse of course content, materials, or access credentials; or
(g) any conduct which, in the reasonable opinion of the Institute, indicates bad faith, dishonest intent, or an attempt to obtain an undue or unfair advantage.
The Institute reserves the right to investigate any such activity and to take such measures as it deems appropriate, including withholding or rejecting refund claims, suspending or terminating User accounts, restricting access to Services, and initiating legal or remedial action in accordance with applicable law.
Any determination made by the Institute under this Clause shall be final and binding.
All requests for refunds or cancellations under this Policy must be submitted to the Institute through the following contact details:
Email: Bimalinstitute@gmail.com
The User shall provide complete and accurate details, including proof of purchase, transaction details, and the grounds for the request, along with any supporting documentation as may be required by the Institute. The Institute shall review such requests and respond within a reasonable time, having regard to the nature of the request and applicable processing requirements.
Users may also raise any grievance or complaint in relation to refunds, cancellations, or payments in accordance with the Institute’s Grievance Redressal Policy, as may be updated from time to time and made available on the Platform.
All decisions of the Institute in relation to cancellations, refunds, and any matters arising under this Policy shall be final, binding, and conclusive, subject to applicable law.
